Terms of Service

These Terms of Service ("Terms") govern your use of our website design, hosting, and maintenance services (the "Services"), offered through this website (the "Site") by Kelowna Webdesign ("we," "us," or "our"). By submitting an inquiry, signing up for a plan, or engaging our Services, you agree to these Terms.

1. Services Offered

We offer three ways to obtain a custom website for your business:

• Subscription: A monthly plan that includes a custom website build, hosting, a free domain for the first year, and a limited number of edits per year, for as long as the subscription remains active.
• Payment Plan: A fixed number of equal, interest-free monthly payments, financed through a third-party provider (such as Affirm). The completed website is delivered upon completion, the same as an Outright Purchase, and includes free hosting and a free domain for the first year. Ongoing edits are not included and may be purchased separately.
• Outright Purchase: A single one-time payment for a completed website that you own outright immediately, including free hosting and a free domain for the first year. Ongoing edits are not included and may be purchased separately.

2. Project Scope

Each plan includes a website of up to five (5) sections/pages, built based on information, content, and feedback you provide. Additional pages, features, or major redesigns beyond the agreed scope may be quoted and billed separately.

3. Payments & Billing

• Subscription plans are billed monthly and renew automatically until cancelled.
• Payment Plan installments are billed and collected directly by our financing provider (such as Affirm) according to the terms you agree to with them at checkout. Any dispute over installment payments is between you and the financing provider and does not affect the website already delivered to you.
• Outright Purchase requires payment as agreed before final delivery/handoff of the completed website.
• Domain registration is free for the first year on all plans. After year one, domain renewal is $25/year on all plans. On the Payment Plan and Outright Purchase, hosting is free for the first year and $145/year afterward; these costs are not included in the base plan price.

4. Cancellation & Refunds

Subscription plans may be cancelled at any time; cancellation takes effect at the end of the current billing period, and no partial-month refunds are issued. Once work has begun on a Payment Plan or Outright Purchase project, payments made are non-refundable, though we will work with you in good faith to resolve any dispute about work delivered.

5. What Happens If You Cancel a Subscription

If a subscription is cancelled, hosting and domain services provided under that subscription will be discontinued at the end of the billing period. If you would like to keep the website after cancelling, it is available at our standard Outright Purchase price, the same as for any new customer.

6. Edits & Support

Subscription plans include a limited number of edits per year, covering routine content updates (text, images, hours, pricing, and similar changes). Requests beyond the included allotment, or requests for new pages/features, will be quoted separately before work begins.

7. Ownership

For Outright Purchase and Payment Plan projects, ownership of the completed website transfers to you upon completion and delivery. For Subscription plans, the website is built and hosted for your use for as long as the subscription is active; see Section 5 for what happens if you cancel.

8. Content & Your Responsibilities

You are responsible for providing accurate, lawful content (text, images, business information) for your website and for ensuring you have the rights to use any content you supply. We reserve the right to decline to publish content that is unlawful, infringing, or otherwise inappropriate.

9. Limitation of Liability

Services are provided on an "as is" basis. We are not liable for indirect, incidental, or consequential damages, including loss of business, revenue, or data, arising from use of the Services, to the fullest extent permitted by law.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
